Warranty Conditions
Article 1 - Warranty Period
1.1 Van Nicholas will replace (not repair) any titanium frame that fails due to defects in materials or workmanship during the lifetime of the frame. Every bicycle has a limited service life, referred to as its useful lifecycle. The duration of this lifecycle depends on the frame type, how and under what conditions the bicycle is ridden, and the care and maintenance it receives. The warranty period is determined based on the bicycle's useful lifecycle.
For purposes of this warranty, "lifetime of the frame" means the expected useful service life of the frame as determined by Van Nicholas, taking into account product design, materials, frequency of use, rider weight, riding conditions, maintenance history and other relevant factors.
a. Van Nicholas estimates the average lifespan of its frames to be 25 years.
b. This warranty becomes void under the circumstances described in Article 2.
1.2 The warranty applies exclusively to the original and first owner of the Van Nicholas frame.
1.3
Van Nicholas Titanium branded accessories and Van Nicholas Technologies (VNT) branded components are warranted against defects in materials and workmanship for a period of two (2) years from the original purchase date by the first owner.
1.4
No warranty is provided for wear-and-tear items such as tires, chains, chainrings, sprockets, cables, handlebar tape, grips and brake pads, unless a manufacturing or material defect exists.
1.5
Components not manufactured by Van Nicholas are covered by the original manufacturer's warranty. Any warranty claims must be submitted directly to the manufacturer's customer service department.
1.6
Factors that may affect a bicycle's useful lifecycle include but are not limited to; racing and intensive training use, use outside the bicycle's intended purpose, excessive weight loads, riding in all weather conditions or different climates, geographical and environmental conditions. Van Nicholas recommends regular inspections by an authorized Van Nicholas dealer to detect potential issues such as corrosion, cracks, deformation or misuse. These inspections are important to help prevent accidents and injuries and are generally not provided free of charge.
Article 2 - Warranty Limitations
2.1
The warranty is void in the following situations:
a. Improper, negligent, or unintended use of the bicycle, including cosmetic or structural damage, defects, or loss resulting from misuse, accidents, falls, collisions, owner negligence, improper installation or assembly, inadequate or delayed maintenance, unauthorized modifications or additions, alterations to the original product, extreme stunts or abnormal use beyond the bicycle's intended design. Bent frames, forks, handlebars, seat posts or rims may indicate misuse or abuse.
b. The bicycle has not been maintained in accordance with the user manual.
c. The bicycle is used for rental purposes or made available to multiple unspecified users.
d. Climatic influences such as normal aging, weathering or corrosion resulting from paint damage.
2.2
Small cracks may develop at bonded joints due to surface tension between the coating and the fork material. This does not indicate a structural defect. Micro-cracks in the coating appearing after one year of use are not covered by warranty.
2.3
The warranty covers replacement only and does not include repairs or cash refunds.
2.4
Minor visual imperfections, normal discoloration, surface marks, scratches, decal wear and other cosmetic changes that do not affect structural integrity, performance or safety are not covered under this warranty.
Article 3 - Warranty Procedure
3.1
Warranty claims must be submitted through the Van Nicholas dealer from whom the bicycle was purchased. Proof of purchase from Van Nicholas or an authorized Van Nicholas dealer is required for warranty replacement or crash replacement claims. Proof of purchase and/or ownership documentation delivered with the bicycle must also be provided to the dealer.
3.2
If the owner has moved or the original dealer is no longer available, Van Nicholas will provide information regarding the nearest authorized Van Nicholas dealer upon request.
3.3
If Van Nicholas replaces a defective frame or component, a replacement of equal value (or higher value at additional cost) will be supplied. Due to inventory availability and current model ranges, the replacement frame may not be identical to the originally purchased model.
3.4
Proprietary components that are no longer compatible with the replacement frame or are no longer available may be substituted with new components. Van Nicholas offers customers a 50% discount on such replacement parts.
3.5
Van Nicholas covers applicable warranty processing costs up to €75 to the dealer, when handled by an authorized Van Nicholas dealer. All other transportation costs for shipping the bicycle and/or components to Van Nicholas are the owner's responsibility as are any costs related to transferring parts from the old frame to the replacement frame.
3.6
If the customer chooses to repair a defective product themselves or uses someone other than an authorized Van Nicholas dealer, Van Nicholas shall not be liable for any damage, defects or losses resulting from the use of such unauthorized services or components.
3.7
Upon receipt of all required information and the returned product where applicable, Van Nicholas will assess the warranty claim within a reasonable period and inform the claimant of the outcome.
3.8
Any frame or component supplied under this warranty shall remain covered for the remainder of the original warranty period applicable to the replaced product.
3.9
Van Nicholas reserves the right to inspect, photograph, test and retain any product that is the subject of a warranty claim where permitted by applicable law.
Article 4 - Crash Replacement Warranty
4.1
If a Van Nicholas titanium frame is damaged and the damage is not covered under the manufacturer's warranty, Van Nicholas will provide a replacement frame at 50% of the current retail price. This additional warranty is intended for individuals whose frame has been damaged as a result of a crash or accident. This warranty is valid only for the original owner and upon presentation of the original invoice.
Article 5 - Liability
5.1
Van Nicholas shall not be liable for any incidental or consequential damages, losses or expenses relating to Van Nicholas bicycle products. To the extent permitted by applicable law, Van Nicholas's liability under this warranty is expressly limited to the replacement of products that do not conform to this warranty.
5.2
To the maximum extent permitted by applicable law, this warranty replaces any and all other express or implied warranties not expressly stated herein, including warranties of merchantability and fitness for a particular purpose.
5.3
Acceptance of a warranty claim by Van Nicholas does not automatically constitute acceptance of liability for any resulting damages. Van Nicholas's liability is limited to the remedies expressly provided under these warranty conditions. Any liability for indirect or consequential damages is expressly excluded. Nothing in this warranty excludes or limits any liability that cannot be excluded or limited under applicable law.
Article 6 - Governing Law
To the extent permitted by applicable law, this Limited Warranty shall be governed by the laws of the Netherlands.
